Awarri Technologies Limited (collectively referred to as “Awarri”, “we”, “us” or “our” in this Privacy Policy) is enabling the development and adoption of frontier technology on the African continent by leveraging on Artificial Intelligence to build lasting technological solutions. Awarri respects your privacy and is committed to protecting your Personal Data. This Privacy Policy will inform you as to how we will utilize and look after your Personal Data when you provide it to us for use in our Large Language Model project (the “Project”) including your privacy rights and how the law protects you.

By clicking the consent button on our website or signing a physical copy of this Privacy Policy, you accept the terms of this Privacy Policy and consent to our collection, use, disclosure and retention of your information as described herein (including to contact you), and for all other purposes permitted under applicable personal information privacy statutes, anti-spam legislation, and consumer protection laws.

Awarri is the data controller and is responsible for your Personal Data However, it is also possible for Awarri to act as data processor, depending on specific contractual obligations that are made known to you.

We keep our Privacy Policy under regular review. It is important that the Personal Data we hold about you is accurate and current. Please keep us informed if your Personal Data changes at any time.

THE DATA WE COLLECT ABOUT YOU
4.1 Personal Data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

4.3 We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your Personal Data but is not considered Personal Data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing our website or application. However, if we combine or connect aggregated data with your Personal Data so that it can directly or indirectly identify you, we treat the combined data as Personal Data which will be used in accordance with this Privacy Policy.

5.1 Direct User Contributions

We may also receive Technical Data about you if you visit other websites and applications employing our cookies.

7.2 Note that we may process your Personal Data for more than one lawful ground depending on the specific purpose for which we are using your data. In addition, your personal data will be encrypted, we will ensure to limit access to your Personal Data to those employees directly concerned with the Project. We will ensure that we will carry out regular security audits and penetration testing on your personal data.
9.2 We have put in place procedures to deal with any suspected Personal Data breach and will notify you and any applicable regulator of a breach where we are legally required to do so. Informing shall take place immediately without any undue delay, and in any case no later than 24 hours from the time on which it first became apparent that the breach had taken place.
9.3 If and where it is not possible to provide the information at the same time, it may be provided gradually without undue delay.
9.4 In any case, we shall cooperate with you or any other stakeholder and shall take all necessary actions, commercial and other, in accordance with the instructions of the competent authority, if any, for the purpose of investigating, limiting possible consequences and restoring to the fullest possible degree any Personal Data Breach.

10.1 How long will you use my Personal Data for?
10.1.1 We will only retain your Personal Data for as long as reasonably and obligatory necessary to fulfil the purposes we collected it for. We may retain your Personal Data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
10.1.2 To determine the appropriate retention period for Personal Data, we consider the amount, nature and sensitivity of the Personal Data, the potential risk of harm from unauthorised use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal, regulatory or other requirements.
10.1.3 In some circumstances you can ask us to delete your data (see below for further information).
10.1.4 In some circumstances we will anonymise your Personal Data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

11.1.1 Request access to your Personal Data

This enables you to ask us to delete or remove Personal Data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your Personal Data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your Personal Data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
11.1.4 Object to processing of your Personal Data
Object to processing of your Personal Data where we are relying on a legitimate interest and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your Personal Data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
11.1.5 Right to withdraw consent
You may withdraw consent, if previously granted, at any time where we are relying on consent to process your Personal Data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent.
